The Federal High Court in Lagos has upheld the ban on motorcycles (Okada) and tricycle (Keke Maruwa) by the Lagos State Government in some Local Government Area of the state.
This decree was enacted following Justice Mohammed Liman’s agreement with the argument of Lagos State Attorney-General, Moyosore Onigbanjo, SAN, that the restriction of motorcycles and tricycles on Lagos major roads has a legal backing according to the Transport Sector Reform Law, 2018.
The High court judge annulled and dismissed the ground merit of the fundamental rights suit filed by a lawyer, Olukoya Ogungbeje, contravening the Lagos State Governor’s authority, Babjide Sanwo-Olu executive order to restrict the movement of Okada’s and Keke in the state.
The presiding judge, while delivering judgment on the suit, no. FHC/L/CS/173/2020 between Olukoya Ogungbeje V Lagos State Government & 7 Others agrees that he takes a ruling on the case on the basis pf the fact that the Federal High Court and State High Court has the same jurisdiction on Fundamental Human rights cases.
“The restriction of motorcycles, tricycles within six Local Government Areas and nine Local Council Development Areas in the State is not an infringement of Fundamental Human Rights,” Justice Liman held.
Ogungbeje, who claims to own a car and not a motorcycle or tricycle, could not argue that his right was withdrawn from him by the imposed executive ban on both mediums of transportation in some LGA in the state.
