A Grade I Area Court in Kubwa has issued a bench warrant authorising the arrest of a mechanic, Mr Christian Tubaba, for alleged cheating.
The defendant was the subject of a direct criminal complaint from the complainant, Mr. Mazi Amaralam, for alleged criminal deceit and breach of trust.
The court summons were delivered to the defendant on February 2 according to the proof of service, according to the judge Yahaya Sheshi.
However, Sheshi issued the warrant authorising the defendant’s arrest and continued the case for a hearing until February 15.
The complainant claimed that on December 10, he had given the Byazhin across defendant Kubwa his Peugeot 406 for repairs.
Amaralam claimed that the defendant gave him a quote for the repairs and his labour in the amount of N48,000.
In addition, the defendant claimed that he spent N9,500 on engine oil, N1,000 on an oil filter, N6,000 on a wheel spanner, and N16,000 on other items.
The complainant said the defendant refused to repair the vehicle after dismantling the car engine.
He however prayed for the court to charge the defendant for the said offence and award a compensation of N81, 000.
The offence of criminal breach of trust and cheating contravenes the provisions of sections 312 and 322 of the Penal Code.
According to section 312, whoever commits criminal breach of trust shall be punished with imprisonment which may extend to seven years or with a fine or both.
Section 322 states that whoever cheats shall be punished with imprisonment for a term which may extend to three years or with fine or both. (NAN)
