The Supreme Court has ruled against all the hurdles hindering the All Progressive Congress, APC, in Rivers State.
After six years of apathy and seemingly endless litigation between the two leaders of the party, Rotimi Amaechi, Minister of Transportation, and Senator Magnus Abe, the apex court ruled that the party’s decision are supreme.
Also, the Court in a ruling read by Justice Amina Adamu Augie, upholds the ruling of the Appeal court declaring Isaac Abbot-Ogbogbula as the Chairman of the APC in Rivers State, as he was earlier appointed as the national leader of the party in the state,
Justice Augie ruled against the decision on the Igo Auma V All Progressive Congress and 2 Others (SC.17/2021) case reached by the Rivers State High Court, where Justice George Omereji, Rtd, presided on, stating that the Court lacked the legal boundary to address the case.
“A political party is Supreme over its own affairs. The Appeal is meritorious. Onuoha v. Okafor; A party is like a club with voluntary membership to be so bound by its own rules. The issue of leadership is an internal domestic affair, and the jurisdiction of the Court is ousted. The subject matter of the Appeal is not justifiable. The Cross-Appeal is struck out,” the Court declared.
The Supreme court insists that it’s not within the jurisdiction of the Court to preserve the rights and privileges of the members of the political party, especially the APC, declaring that ”it is an internal party matter.”
